Introduction

Welcome to InstantStudio ToolKit ("Service"), a product developed and hosted by InstantStudio ("We", "Our"). By using this Service, you ("User") agree to comply with and be bound by the following Terms of Service and Privacy Policy.

Data Collection and Use

  • We may collect personal information such as your email address for marketing purposes. You consent to receive occasional marketing communications from InstantStudio.
  • Your personal data will never be sold to third parties.
  • All collected data is securely stored on InstantStudio servers.
  • Generated image data is shared exclusively with the Creator who created the Custom Endpoint. The Creator determines how long image data is retained, but in no circumstances will image data be stored longer than 30 days. After this period, image data is permanently destroyed.

User Responsibilities and Content Guidelines

  • You must own or have rights to any images you upload.
  • You may not upload images depicting violence, nudity, hate speech, terrorist propaganda, illegal activities, or otherwise harmful content.
  • The Service must not be used to generate images that depict violence, harm, hate speech, terrorist propaganda, illegal activities, or other disturbing material, or for any harmful or illegal purpose.
  • Due to the nature of AI-generated content, InstantStudio cannot guarantee the quality, accuracy, or appropriateness of generated images. Users acknowledge that the Service may produce unintended artifacts, disturbing imagery, or unexpected results. You use the Service at your own risk.

Intellectual Property Rights

  • You retain full rights to the original images you upload. InstantStudio and the Creator do not claim ownership of your uploaded content.
  • InstantStudio or the Creator may use generated images solely for the operation and delivery of the Service as defined by these terms.

Third Party Sources

Some features provided by the Service may be provided by a third party. Using these features is not covered by the terms in this document.

These features will be clearly labeled in the Service and using these features is done at your own risk.

Warranty Disclaimer

The Service is provided on an "as is" and "as available" basis. InstantStudio makes no warranties or representations of any kind, express or implied, regarding the reliability, suitability, availability, timeliness, or accuracy of the Service.

Indemnification

You agree to indemnify and hold harmless InstantStudio, its affiliates, employees, and the Creator from any claims, damages, liabilities, or expenses arising from your use of the Service or violation of these terms.

Limitation of Liability

InstantStudio is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to damage resulting from generated images or loss of data.

Updates to Terms

We reserve the right to modify these terms at any time. Changes will be posted here, and your continued use of the Service constitutes acceptance of any new terms.
